Terms and Conditions of Clarke’s Executive Car Services

These terms and conditions govern the use of Clarke’s Executive Car Services, a private car hire with driver business (“the Company”). By using the Company’s services, you agree to these terms and conditions.

1. Bookings

1.1. To make a booking, please contact the Company by phone or email.

1.2. The Company will confirm your booking by email, which will include the date, time, and location for pick-up and drop-off.

1.3. The Company will provide you with the name and contact details of your driver prior to your journey.

2. Prices

2.1. The Company’s prices are inclusive of VAT, and are based on the distance and time required for the journey.

2.2. The Company reserves the right to amend prices at any time, but will always provide notice to you before doing so.

2.3. In the event that your journey is delayed due to unforeseen circumstances, such as traffic, adverse weather conditions, or industrial action, the Company reserves the right to charge a surcharge of £20 per hour for any waiting time.

3. Payment

3.1. Payment must be made in full prior to the commencement of your journey, either by cash, debit or credit card.

3.2. If payment is not made in full, the Company reserves the right to cancel your booking.

4. Cancellation

4.1. If you need to cancel your booking, please notify the Company as soon as possible.

4.2. The Company may charge a cancellation fee if the cancellation is made less than 24 hours before the scheduled pick-up time.

4.3. The Company understands that industrial action may cause disruptions to your travel plans.  A cancellation fee may be chargeable if the client makes the  cancellation less than 24 hours before the scheduled pick-up time.

4.4. In the event of delays or cancellations (instigated  by the Company) due to industrial action beyond our control, the Company will work with you to find suitable alternatives or reschedule your booking, subject to availability.

5. Airport Transfers & Pickups and Changes to Flight Times and Dates:

5.1. When booking an airport transfer with Clarke’s Executive Car Services, it is your responsibility to provide accurate and up-to-date flight information, including the airline, flight number, and scheduled arrival time.

5.2. Our drivers will monitor flight arrivals and adjust the pickup time accordingly to ensure timely service. However, we cannot be held responsible for delays or changes in flight schedules beyond our control.

5.3. In the event of flight delays, it is essential that you notify us as soon as possible to make necessary adjustments to your pickup time. We will do our best to accommodate the revised schedule, subject to driver availability.

5.4. Our drivers will wait for up to 60 minutes after the flight has landed, free of charge. If you anticipate a longer delay, please contact us to discuss alternative arrangements. Additional waiting time may incur an extra charge, as specified in our pricing policy.

5.5. Changes to Flight Times and Dates.  If you need to make changes to your flight time or date after booking an airport transfer with us, please notify us immediately. We will make every effort to accommodate your new schedule, subject to driver availability.

5.6. Any changes to flight times or dates may result in adjustments to your pickup time and may incur additional charges, depending on the revised schedule and our pricing policy.

5.7. Clarke’s Executive Car Services reserves the right to decline or modify any requested changes to flight times or dates that conflict with our availability or capacity to provide the service.

5.8. Cancellations. If you wish to cancel your airport transfer booking, please notify us at least 24 hours prior to the scheduled pickup time. Cancellations made within 24 hours may incur a cancellation fee, as specified in our pricing policy.

5.9. In the event of flight cancellations by the airline or unforeseen circumstances beyond your control, please inform us as soon as possible. We will work with you to find suitable alternatives or reschedule your transfer, subject to availability and our cancellation policy.

5.10. Liability.  While Clarke’s Executive Car Services strives to provide reliable and punctual airport transfer services, we cannot be held responsible for circumstances beyond our control, including but not limited to flight delays, cancellations, or changes due to airline operations, weather conditions, or security issues.

5.11. The liability of Clarke’s Executive Car Services is limited to the provision of private hire transportation services and will not extend to any losses, damages, or costs incurred as a result of flight delays, cancellations, or changes.

6. Liability

6.1. The Company will not be liable for any loss, damage or injury suffered by you, unless such loss, damage or injury is caused by the negligence of the Company or its employees.

6.2. The Company will not be liable for any loss, damage or injury caused by events outside of its control, such as traffic accidents, road closures, adverse weather conditions, or industrial action.

7. General

7.1. These terms and conditions are governed by the laws of England and Wales.

7.2. The Company reserves the right to amend these terms and conditions at any time, and will always provide notice to you before doing so.

7.3. If any part of these terms and conditions is found to be invalid or unenforceable, the remainder of the terms and conditions will remain in full force and effect.
